Summary
Decision No. 56/2015/QD-UBND, issued by the People's Committee of Lam Dong Province on November 26, 2015, promulgates the regulations governing the management and use of the certification mark “Sầu riêng Đạ Huoai” (Da Huoai Durian). The Decision establishes scope and subjects of application, management responsibilities, conditions for using the certification mark, procedures for granting use authorization, inspection and supervision, handling of violations, and transitional and implementation provisions. The regulations apply to organizations and individuals producing, processing, trading, storing, transporting, packaging, labeling, or advertising durian and durian products that seek to use the certification mark; state agencies and inspection bodies involved in certification mark management; and domestic and foreign entities involved in verification, certification, and trade of the certified product. The People's Committee of Lam Dong assigns the provincial Office of Science and Technology (or the designated competent body) to manage the certification mark, maintain a register of authorized users, appoint or accredit inspection bodies, and organize technical and administrative procedures for certification. Conditions for use include compliance with the Da Huoai Durian product specifications, origin and traceability requirements, quality and safety standards, approved packaging and labeling, and payment of prescribed fees. Authorized use is granted upon receipt of a complete application dossier, successful inspection and conformity assessment, and execution of a license or authorization contract specifying rights and obligations, term of authorization, quality control measures, and permitted sign forms. The Decision prescribes inspection and surveillance measures, periodic and ad-hoc audits, and obligations of authorized users to permit inspections, keep records, ensure product traceability, and maintain conformity. Violations such as unauthorized use, false labeling, alteration of marks, or failure to meet product standards are subject to suspension, revocation of authorization, fines, destruction of nonconforming products or corrective measures, and civil or administrative liability per relevant laws. The Decision provides timelines for transitional arrangements for existing users, requires the provincial agencies to guide implementation, and assigns responsibility for dissemination and enforcement beginning from the effective date specified therein.
