Decision No. 11/2023/QĐ-UBND of the People's Committee of Thừa Thiên Huế Province, dated 23 February 2023, promulgates the Regulation on unit prices for crops and trees as the basis for determining compensation and support value when the State recovers land in the province in 2023. It is grounded on the 2012 Law on Prices, the 2013 Law on Land, Decrees No. 177/2013/NĐ-CP and 149/2016/NĐ-CP, the proposal of the Department of Agriculture and Rural Development in Submission No. 204/TTr-SNNPTNT and the legal appraisal report of the Department of Justice, both dated 10 February 2023. It applies to land users under Article 5 of the 2013 Law on Land, land-administration agencies, compensation and site-clearance organisations and related parties. Compensation principles follow clause 1, Article 90 of the Law on Land, with non-compensable cases under Article 92. The unit prices already include felling and removal costs; the compensated person may salvage all products, relocate or sell the trees, and an investor wishing to retain trees for landscaping must negotiate an additional payment with the compensated person. For species not listed, the clearance organisation applies the price of an equivalent species, subject to approval by the competent People's Committee. The Decision is effective from 6 March 2023 to 31 December 2023; projects with compensation plans approved before effectiveness follow the approved plans, while plans not yet approved must apply or be adjusted to this Decision. The appended schedule sets 2023 prices in four parts. Part A covers 41 annual crops in đồng per hectare, per square metre and per plant, for example cabbage and kohlrabi at 88,573,720 đồng per hectare (8,860 đồng per square metre), pure-bred rice 38,343,600, hybrid rice 49,793,430, upland rice 53,255,000, peanut 36,579,790, maize 37,065,480, chilli 96,657,830, and lotus and water lily 115,989,390 đồng per hectare. Part B covers perennials: long-duration crops such as fruiting banana (7,030–26,730 đồng per plant), dragon fruit (56,240–140,590 đồng per post) and grape (12,650–37,960 đồng per square metre); fruit and industrial trees priced by trunk diameter or plantation age, including thanh trà up to 2,626,540 đồng per tree, pomelo up to 1,970,440, durian up to 542,140, mangosteen up to 6,424,680, orange and mandarin up to 695,510, coffee up to 54,320, pepper up to 249,230, macadamia up to 1,313,270, and coconut up to 645,450. Part III prices 65 timber, firewood, resin and shade species both for concentrated planting (đồng per hectare, e.g. rubber up to 314,093,730; agarwood and Sưa đỏ up to 204,499,200) and scattered planting (đồng per tree). Part IV covers ornamental, medicinal and other plants, for instance yellow apricot (hoàng mai) from 42,600 to 4,260,400 đồng per tree by diameter class, hedge plants 53,260 đồng per metre, potted-plant transport support 5,330–53,260 đồng per pot, and bamboo groups priced per hectare, per culm or per clump. The Department of Agriculture and Rural Development monitors yields and price movements and proposes timely adjustments to the provincial People's Committee.
