This is a decision of the Bến Tre Province People's Committee, signed on 7 August 2020, that promulgates the regulation on crop compensation when the State recovers land in the province. It is based on the 2013 Land Law, the 2012 Law on Prices, Government Decree No. 47/2014/NĐ-CP, and related guidance, at the proposal of the Department of Agriculture and Rural Development. The regulation sets the densities and methods used to calculate crop-damage compensation for land users.

  • Establishes methods for valuing crop damage: annual crops by the highest-yield harvest over the prior three years at average local prices; perennial crops by the current value of the orchard, excluding land-use value.

  • Classifies gardens for compensation purposes (specialized, mixed with scattered/intercropped plants, multi-species intercropped, and uncared 'vườn tạp' at up to 70% of unit price).

  • Sets maximum planting densities per hectare for principal crops (e.g., coconut up to 200–250/ha; durian and mangosteen 200/ha; citrus 1,200/ha) and grades fruit trees into age-based classes.

  • Treats timber and shade trees (e.g., eucalyptus, sao, dau) as felling-cost support graded by trunk diameter, and ornamental/potted plants as removal-and-relocation support.

  • Allows up to 1.5x the average unit price for elite trees, rare seedlings, large-canopy trees, or trees over 20 years old, and 100% pricing for trees in public-interest infrastructure corridors.

  • Tasks the Department of Agriculture and Rural Development to issue an average crop price notice each December for the following year.

The regulation applies province-wide in Bến Tre and takes effect from 20 August 2020, replacing Decision No. 31/2015/QĐ-UBND of 9 November 2015 on the crop price table for land-recovery compensation.
