This is a Circular of the Ministry of Industry and Trade, dated 14 February 2023, that amends and supplements Circular No. 22/2016/TT-BCT of 3 October 2016, which implements the Rules of Origin under the ASEAN Trade in Goods Agreement (ATIGA). It updates the product-specific rules and related annexes used to determine the origin of goods traded among ASEAN member states.

• Replaces the Product-Specific Rules and related annexes previously issued under Circular No. 22/2016/TT-BCT (as amended by Circulars No. 10/2019/TT-BCT and No. 25/2019/TT-BCT) with new Annexes I, II, and III attached to this Circular.

• The updated annexes set origin criteria for numerous goods, expressed in terms such as Regional Value Content of 40% (RVC40) or change of tariff classification (e.g., CC) at the listed HS headings.

• Repeals Circular No. 10/2019/TT-BCT (22 July 2019) and Circular No. 25/2019/TT-BCT (14 November 2019) of the Minister of Industry and Trade.

• Issued under the Law on Foreign Trade Management implementing decree on rules of origin and pursuant to the ATIGA and its amending protocol signed 22 January 2019 in Vietnam.

• Proposed by the Agency of Foreign Trade (Cục Xuất nhập khẩu) and issued by the Minister of Industry and Trade.

The Circular applies nationally to determinations of preferential origin for goods under ATIGA and takes effect from 1 April 2023.
