Decision No. 08/2020/QD-UBND Amending and Supplementing Provisions on Management of Public Internet Access Points and Public Electronic Game Service Points in Bac Lieu Province

Decision No. 08/2020/QD-UBND, issued by the People's Committee of Bac Lieu Province on 19 March 2020, amends and supplements parts of the Regulation on management of public electronic game service points and public Internet access points that was promulgated under Decision No. 10/2018/QD-UBND dated 12 March 2018. The Decision is issued pursuant to the Law on Organization of Local Government, relevant Government Decrees (72/2013/ND-CP, 27/2018/ND-CP, 150/2018/ND-CP) and Circular 24/2014/TT-BTTTT, and upon the proposal of the Director of the Department of Culture, Information, Sports and Tourism. It revises multiple articles to align local rules with national legal provisions concerning prohibited acts, rights and obligations of operators, operating conditions, operating hours, licensing procedures and reporting obligations. Key changes include: (i) Article 2 now expressly prohibits acts listed in Article 5 of Decree 72/2013/ND-CP and Article 3 of Circular 24/2014/TT-BTTTT; (ii) Article 3 cross-refers rights and obligations of public Internet access point owners to Clause 2, Article 1 of Decree 27/2018/ND-CP; (iii) Article 4 adopts the conditions for public electronic game service points set out in Clauses 35 and 36, Article 1 of Decree 27/2018/ND-CP and sets owners rights and obligations to those in Article 36 of Decree 72/2013/ND-CP and Clause 41, Article 1 of Decree 27/2018/ND-CP; (iv) Article 5 sets operating hours: Internet agencies and public Internet access points of ISPs may operate daily from 08:00 to 22:00; public electronic game service points are prohibited from operating between 22:00 and 08:00; public Internet access points in hotels, restaurants, quays, stations, cafes and other public venues not providing electronic game services follow the host venue's opening hours; all such points must publicly post daily opening and closing times; (v) Article 6 clarifies ISP obligations including exercising rights and duties under Article 7 of Decree 72/2013/ND-CP, suspending service and terminating agency contracts with household agent businesses per contract terms, and periodic reporting as required by Article 27 of Circular 24/2014/TT-BTTTT; (vi) Articles 7 and 8 update users rights and obligations references and vest authority for issuance, amendment, renewal and revocation of certificates of eligibility for public electronic game service points with district-level People's Committees, prescribe establishment of assessment teams and apply procedures under Clauses 37-40, Article 1 of Decree 27/2018/ND-CP. The Decision amends and supplements Decision No. 10/2018/QD-UBND; it takes effect upon issuance (19 March 2020) or as provided in the Decision.
