Decision No. 22/2020/QD-UBND of the People's Committee of Lam Dong Province promulgates the schedule of unit prices used to calculate compensation for damage to crops when the State recovers land within Lam Dong Province. The Decision is issued pursuant to the 2013 Land Law, Decree No. 43/2014/ND-CP, Decree No. 01/2017/ND-CP and Circular No. 37/2014/TT-BTNMT, on the proposal of the Director of the Department of Agriculture and Rural Development. It takes effect on 31 March 2020, replaces Decision No. 03/2013/QD-UBND dated 18 January 2013, and also governs cases arising before its effective date that competent authorities have not yet resolved. The schedule sets standard rates for grade-A crops, meaning crops cultivated according to correct technical processes and achieving fair or better yields. Poorly tended crops are classified grade B (75 per cent of the grade-A price) or grade C (50 per cent). New or high-quality grafted fruit varieties absent from the schedule are compensated at 1.2 times the price of the equivalent listed variety. Where pure stands exceed standard planting density and the orchard is verified as 100 per cent grade A, compensation follows the actual tree count but is capped at 1.1 times standard density; stands below standard density are paid on the actual count. Crops on land recovered for new roads, irrigation canals or power lines are valued by the standard-density method, while land recovered to expand such works is compensated on actual quantity and quality up to 1.5 times standard density. Movable crops are compensated for labour costs and forecast yield loss; intercropped areas receive the sum of each crop's value, capped at 1.5 times the value of the main crop grown in monoculture. For specified vegetables in Da Lat, Don Duong, Duc Trong and Lac Duong (cabbage, cauliflower, broccoli, tomato, potato, carrot and others), unrecovered land-investment costs are added, subject to the same 1.5-times ceiling. Project-based planted forests and unlisted species are appraised case by case through the Departments of Agriculture and Rural Development and of Finance. Illustrative rates include single-crop rice at 4,000 VND/m2 and specialty rice at 8,500 VND/m2; cabbage 20,000 VND/m2; greenhouse strawberries 112,500 VND/m2; raspberries 242,000 VND/m2; Robusta coffee from year four 271,000 VND/tree; grafted durian from year eight 5,477,000 VND/tree; mangosteen from year eleven 2,126,000 VND/tree; and pepper on brick pillars from year four 466,000 VND/tree. Potted ornamental plants receive relocation support scaled by pot diameter, reduced progressively from 50 per cent to 20 per cent for holdings above 100 pots. The Department of Agriculture and Rural Development, in coordination with the Department of Finance, guides implementation.
