Legal basis and scope

This Law, Law No. 87/2025/QH15 adopted by the National Assembly, amends and supplements a number of articles of the Law on Promulgation of legal normative document No. 64/2025/QH15. It was promulgated on the basis of the Constitution of the Socialist Republic of Vietnam as amended and supplemented under Resolution No. 203/2025/QH15. The Law revises the regime for making, promulgating, publishing, reviewing and systematizing legal normative documents by central and local state bodies.

System of documents and publication requirements

Article 4 on the system of legal normative documents is revised, retaining the hierarchy headed by the Constitution, followed by Laws and resolutions of the National Assembly, ordinances and resolutions of the Standing Committee of the National Assembly, and other instruments. Article 9 is amended to require that legal normative documents issued by central competent agencies and individuals be published on the electronic Official Gazette of the Socialist Republic of Vietnam. Complementary amendments to Articles 44, 46, 47, 48 and 49 require draft orders and decisions of the President, draft resolutions of the Council of Judges of the Supreme People's Court, draft circulars of the Procurator General of the Supreme People's Procuracy, of the State Audit Office, and joint circulars to be posted on the portals of the drafting bodies and on the National Law Portal for at least 20 days for public comment, subject to Article 51 of this Law. Depending on nature and content, the lead drafter may also send drafts for comment to relevant lower courts, procuracies or members of the Council of Judges.

Legislative programming and law-making procedures

Articles 23, 24 and 26 revise legislative programming. The Standing Committee of the National Assembly, in coordination with The Government, shall formulate the legislative orientation for the National Assembly's term within 90 days, as a basis for annual law-making programmes and for addressing emerging practical problems. An urgent procedure is provided where a law or resolution needs to be adopted at the ongoing or next session to resolve urgent obstacles.

Articles 29, 31, 33, 34 and 37 revise policy impact assessment and dossier preparation. Economic-social impacts must be assessed on the basis of analysis and forecasting of costs, benefits and positive and negative impacts. The Ministry of Justice shall preside and coordinate with the Ministry of Finance, Ministry of Home Affairs, Ministry of Foreign Affairs, Ministry of Public Security, Ministry of National Defence and other ministries in appraisal, and agencies must solicit social counter-argument opinions of the Vietnam Fatherland Front. Drafts submitted to the National Assembly must be sent to the presenting agency no later than 45 days before the opening of the session. Article 50 clarifies authority of the Standing Bodies of the People's Councils to decide on application of the summary procedure, and Article 51 revises appraisal and verification of legal normative documents and the Government's commenting on non-Government projects.

Local instruments and effect, review and systematization

Articles 21 and 22 revise instruments of Local administrations in special administrative-economic units and at the commune level, and at the provincial level, specifying resolutions of provincial-level People's Councils and decisions of provincial-level People's Committees and chairpersons of provincial-level People's Committees. Articles 54, 55 and 57 revise effect rules: instruments of People's Councils, People's Committees and Chairpersons of People's Committees take effect within the administrative unit that issues them; instruments of chairpersons of provincial-level People's Committees, Commune People's Councils and commune-level People's Committees may not provide retroactive effect. Provisions on expiry in whole or in part when replaced or amended and supplemented are clarified.

The Standing Committee of the National Assembly may on its own initiative or at the proposal of the President, Ethnic Council, Committees of the National Assembly, The Government, Supreme People's Court, Supreme People's Procuracy and other bodies consider handling of unlawful documents.
