Decision No. 106/2025/QD-UBND Promulgating Detailed Provisions on Certain Articles of the 2024 Land Law and Related Decrees

Decision No. 106/2025/QD-UBND of the People's Committee of Son La province, dated 6 October 2025, promulgates detailed provincial regulations implementing certain provisions of the Land Law 2024 and related Government decrees. Issued pursuant to the Law on Organization of Local Government 72/2025/QH15, the Law on Promulgation of Legal Normative Documents 64/2025/QH15 as amended by Law 87/2025/QH15, the Land Law 31/2024/QH15 as amended by Law 43/2024/QH15, and multiple Government decrees (including but not limited to Decrees 71/2024/ND-CP, 88/2024/ND-CP, 101/2024/ND-CP, 102/2024/ND-CP, 103/2024/ND-CP, 112/2024/ND-CP, 62/2025/ND-CP, 78/2025/ND-CP, 79/2025/ND-CP, 187/2025/ND-CP, 131/2025/ND-CP, 136/2025/ND-CP, 151/2025/ND-CP and 226/2025/ND-CP). The Decision is adopted at the proposal of the Director of the Department of Agriculture and Environment and issues eight groups of detailed rules, set out in attached appendices. Those include: (1) limits (han muc) for recognition of residential land, land allocation, limits on acquiring agricultural land rights, areas for agricultural service works, and minimum parcel areas for subdivision and consolidation by land type in Son La (Appendix I); (2) specific rules on compensation, support and resettlement when the State recovers land in the province (Appendix II); (3) detailed provisions implementing selected articles of Government Decree 102/2024/ND-CP and Decree 151/2025/ND-CP concerning division of authority and decentralization in land matters (Appendix III); (4) procedure for transferring files to determine land-related financial obligations of land users (Appendix IV); (5) cases, measures and support levels for relocating livestock by type when land is recovered (Appendix V); (6) coordination rules between the land registration office, its regional branches, commune-level People's Committees, finance and tax authorities, and other agencies in carrying out the functions of the land registration office under the provincial Department of Agriculture and Environment (Appendix VI); (7) provisions on area, location and permitted purposes of constructions serving agricultural production on rice land and rules on payment for protection and development of rice land (Appendix VII); and (8) compensation rates for damage to aquatic livestock and unit prices for compensation for crops and aquatic animals when the State recovers land in Son La (Appendix VIII). The Decision takes effect on 6 October 2025 and replaces earlier provincial Decisions No. 35/2024/QD-UBND (25 September 2024) and No. 36/2024/QD-UBND (1 October 2024), except as otherwise provided (notably clause 3, Article 6 of Appendix VIII).
