Decision No. 74/2025/QD-UBND Promulgating Regulations on Management of Municipal Solid Waste in Ha Tinh Province

Decision No. 74/2025/QD-UBND, issued by the People's Committee of Ha Tinh Province on 20 November 2025, promulgates detailed provincial regulations on the management of municipal solid waste (MSW) within Ha Tinh. The Decision enters into force on the date of signing and expressly replaces Decision No. 15/2023/QD-UBND dated 01 March 2023. It is adopted pursuant to the Laws on Organization of Local Government (16/6/2025), Promulgation of Legal Documents (19/02/2025 and amendments), the Law on Environmental Protection (17/11/2020), and a broad suite of subsequent national decrees and ministerial circulars cited in the text, and follows proposal and legal appraisal by the Department of Agriculture and Environment and the Department of Justice. The attached Regulation (promulgated together with the Decision) defines scope, subjects and terminology, applies to all agencies, organizations, households, and individuals generating MSW in Ha Tinh, service providers engaged in collection, transportation and treatment, and state management bodies. It details application of specific provisions of the Law on Environmental Protection and implementing decrees (including Decree 08/2022/ND-CP as amended), and sets out administrative responsibilities for provincial and local authorities: the Office of the Provincial People's Committee, directors of provincial departments, and chairpersons of commune-level People's Committees are responsible for implementation. The Regulation includes definitions (for example, what constitutes an entity generating MSW and what is a public area), and procedural and enforcement measures consistent with cited national legal instruments. The Decision lists distribution recipients for compliance and public information, and requires conformity with national rules on waste management, inspection, procurement, administrative penalties and financial autonomy where applicable. The Decision mandates execution by specified provincial bodies and provides legal continuity by superseding the prior 2023 provincial decision.
