Decision No. 13/2026/QD-UBND on Decentralising the Implementation and Adjudication of Certain Administrative Procedures in the Field of Industry and Trade within the Competence of the Provincial People's Committee

Decision No. 13/2026/QD-UBND, issued by the Lai Chau Provincial People's Committee on 07 February 2026, decentralises the implementation and resolution of specified administrative procedures in the fields of industry and trade that fall within the competence of the Provincial People's Committee. The Decision is adopted pursuant to the Law on Organization of Local Government (72/2025/QH15), the Law on Promulgation of Legal Documents (64/2025/QH15 as amended by Law 87/2025/QH15), related Government decrees (including Decrees 78/2025/ND-CP, 187/2025/ND-CP, 79/2025/ND-CP, 139/2025/ND-CP, 146/2025/ND-CP) and multiple circulars of the Ministry of Industry and Trade concerning registration of inspection service seals, quality management of products and goods, management and use of industrial explosives, procedures on origin certification and safety technical rules for mining. The Decision applies to the Department of Industry and Trade, the Provincial Economic Zone Management Board, enterprises and individuals operating in industry and trade within the province, and other related agencies and persons. The Decision (Article 2) apportions authority: (i) it assigns responsibility for issuing Certificates of Origin and written approval for exporters to self-certify origin for goods produced outside industrial parks and economic zones to the Department of Industry and Trade; (ii) it assigns responsibility for issuing Certificates of Origin for goods produced inside industrial parks and economic zones to the Provincial Economic Zone Management Board. In total, 36 export-import procedures are addressed in Appendix I, and 32 additional industry and trade procedures are delegated to the Department of Industry and Trade in Appendix II. Article 3 sets organisational responsibilities: the Department of Industry and Trade must chair coordination with relevant bodies to propose public disclosure of the delegated procedure list and internal procedures, be legally accountable for delegated tasks, and report annually to the Provincial People's Committee (no later than 25 December) or ad hoc as requested; the Economic Zone Management Board bears the same legal responsibility and reporting obligation for the procedures delegated to it. The Decision enters into force on 07 February 2026 and expires on 28 February 2027. It does not state that it amends or supersedes a particular earlier provincial decision.
