Decision No. 123/2026/QD-UBND dated 09 August 2026 of the Provincial People's Committee of Gia Lai Province amends and supplements Decision No. 50/2026/QD-UBND dated 21 May 2026 promulgating compensation unit prices for damage to crops and livestock upon land recovery by the State in Gia Lai Province. Issued on the basis of the Law on Organization of Local Administration No. 72/2025/QH15, the Land Law No. 31/2024/QH15 (as amended and supplemented) and the Law on Promulgation of legal normative documents, and upon proposal of the Department of Agriculture and Environment, tham dinh by the Provincial Justice Departments and consensus of members of the Provincial People's Committee, the Decision applies to competent agencies, organizations and individuals involved in compensation for damage to crops and livestock when the State recovers land in the province. It amends the scope of compensation prices, the regime for aquaculture and other livestock, and the appendices prescribing unit prices and specific calculation rules. Article 2 amends the Appendices: in Appendix II, the phrase "hang rao" at Item 15 is abolished and a new Item 28 is added for fences made of plants at 7,500 dong per linear meter for untended natural growth and 18,000 dong per linear meter for tended ornamental growth; in Appendix III, Section A Item 5 cashew density is changed from 400 trees/ha to 208 trees/ha, Item 7 durian from 200 trees/ha to 125 trees/ha, and Item 41 is narrowed from "Thi, tram, bua, chay, tra (10m spacing)" to "Thi, bua, tra (10m spacing)"; Items 4, 6 and 46 of Section B are abolished and replaced by Appendix IIIb for Eucalyptus spp., Acacia spp. and Casuarina. Detailed rules at the end of Appendix III are replaced to govern perennial industrial crops, fruit trees and forestry trees: pre-harvest trees within density norms are compensated at full unit price and excess trees at 50%; perennial interplanted crops are supported at actual quantity but capped at 30% of the pure-stand planting density and priced under Appendix IIIa, while annual interplanted crops are compensated by actual damaged area; trellis posts in business period for pepper, dragon fruit and other climbing crops are supported at 50% of the scattered-tree price for living-tree posts, 25,000 dong per post for wooden posts, 20% of the prescribed unit price for concrete posts, and 100% for brick or stone posts; coffee is compensated by remaining garden output at 30% in business years 1-2, 50% in years 3-4, 70% in year 5 and 100% from year 6 onward; perennials harvested multiple times during harvest period are compensated by remaining unharvested output multiplied by remaining years in the cycle; and crop yield is determined by the highest annual yield in the three immediately preceding years as published in the provincial Statistical Yearbook or provided by the provincial statistics agency.
