Decision 64/2026/QD-UBND Promulgating Regulations on Classification of Other Municipal Solid Waste Arising from Households and Individuals in Tay Ninh Province

Decision No. 64/2026/QD-UBND, dated 06 May 2026, issued by the People's Committee of Tay Ninh Province, promulgates the Regulations on classification of "other" municipal solid waste arising from households and individuals within Tay Ninh province. The Decision is adopted pursuant to national laws and decrees on local government organization and environmental protection, including Law on Organization of Local Government 72/2025/QH15, Law on Environmental Protection 72/2020/QH14 and its subsequent amendments, relevant Government Decrees (notably 08/2022/ND-CP, as amended by Decrees 05/2025/ND-CP and 48/2026/ND-CP) and Ministerial Circulars (02/2022/TT-BTNMT, as amended by 07/2025/TT-BTNMT and 09/2026/TT-BNNMT). The Decision consists of the Decision itself and the attached Regulations. It takes effect on 20 May 2026. The provincial Department of Agriculture and Environment is assigned to lead coordination with provincial departments, agencies and commune-level People's Committees to implement the Decision. Responsibility for enforcement is assigned to the Chief of Office of the Provincial People's Committee, directors of provincial departments, heads of provincial agencies, chairpersons of commune-level People's Committees, and related households and individuals. The attached Regulations define scope, subjects, terms, general principles and institutional responsibilities for on-site segregation and handling of other municipal solid waste generated by households and individuals. The Regulations apply to all households, individuals and organizations involved in classification of such waste in Tay Ninh; bulky waste is excluded and governed by a separate provincial regulation. Key definitions include "other municipal solid waste" and "hazardous waste" as set out in Article 26a of Circular 02/2022/TT-BTNMT (as amended), "collection and transport establishments" (organizations or business households providing collection and transport services), "collection points" (temporary receiving locations for transfer to larger vehicles), and "transfer stations" (temporary accumulation sites for transport to treatment facilities). Core principles require households and individuals to classify waste to promote reuse, recycling, energy recovery and treatment, and encourage adoption of on-site treatment measures. The Regulations set out duties of authorities and service providers to organize collection, transport, temporary reception and transfer in accordance with the defined classifications and national guidance.
