Decision No. 04/2024/QD-UBND Promulgating Regulations on Management of Municipal Solid Waste in Dong Nai Province

Decision No. 04/2024/QD-UBND, issued by the People's Committee of Dong Nai Province and signed on 18 January 2024, promulgates the provincial Regulations on management of municipal solid waste (MSW) within Dong Nai. The Decision adopts the attached regulatory text governing classification, collection, storage, transport and treatment of MSW generated within the province, and defines the responsibilities of provincial agencies, district and city authorities, service providers, organisations, households and individuals. The Regulations implement and specify obligations under the Law on Environmental Protection (2020), Decree No. 08/2022/ND-CP and Circular No. 02/2022/TT-BTNMT, and were adopted at the proposal of the Director of the Department of Natural Resources and Environment. The Decision takes effect on 15 May 2024. It tasks the Chief of Office of the Provincial People's Committee, heads of departments, and chairpersons of district, Long Khanh city and Bien Hoa city People's Committees, as well as commune-level chairpersons, service providers and related organisations and individuals with enforcing the Decision. The Regulations apply to households and individuals residing in Dong Nai (including foreigners), organisations and enterprises whose activities generate domestic-type waste or office waste under 300 kg/day (which may choose to be managed as households), and to entities providing MSW collection, transport and treatment services. Facilities generating MSW above 300 kg/day must comply with prescribed sorting, use of packaging, containers and storage equipment as set out in Articles 5 and 6. Definitions are provided for key terms (MSW, hazardous waste, public area, community, project owner, collection point, transfer station). The Regulations establish general management requirements emphasizing waste minimisation, reuse and recycling to maximise resource recovery. They allocate responsibilities for source separation, proper containment, collection, transport and treatment in accordance with applicable national law, and prescribe that collection, transport and treatment obligations be carried out consistent with the 2020 Environmental Protection Law and implementing regulations. The Decision repeals or supersedes no specific earlier provincial instrument in the text provided, but incorporates national legal instruments as its legal basis.
