Decision No. 38/2017/QD-UBND Amending and Supplementing Certain Contents of the Cold-Climate Coffee Project in Dak Glei, Tu Mo Rong and Kon Plong Districts, issued together with Decision No. 33/2013/QD-UBND of Kon Tum Provincial People's Committee

This Decision No. 38/2017/QD-UBND of the Kon Tum Provincial People's Committee amends and supplements parts of the Cold-Climate Coffee Project established by Decision No. 33/2013/QD-UBND dated 16 August 2013. It was issued by the Provincial People's Committee on 29 December 2017 and takes effect on 15 January 2018. The Decision adjusts project boundaries, planting targets, land allocation, support policies, and implementation responsibilities for the coffee development program in Dak Glei, Tu Mo Rong and Kon Plong districts. The Decision revises the project scope to specifically include commune and village names within the three districts where coffee planting on cold-climate varieties is encouraged and regulated. It modifies planting area targets and allowable maximum area per household and per economic unit; sets criteria for beneficiary households, cooperatives and enterprises; and clarifies that households already having coffee may be eligible under conditions. The Decision updates land use procedures, requiring land to be allocated or leased in accordance with current land law and provincial regulations, and specifies that support is provided only for newly planted or replanted coffee on plots with clear land use rights. Support measures are adjusted and quantified, including funding for planting materials, technical assistance, care and protection, irrigation and anti-frost measures, and for construction of small irrigation works; the Decision sets specific support rates, eligible cost items and disbursement conditions. It also clarifies responsibilities of implementing agencies: the Department of Agriculture and Rural Development leads technical guidance and monitoring; the Department of Natural Resources and Environment and district authorities coordinate on land and environmental compliance; the Department of Finance organizes fund management and disbursement; and district People's Committees direct local implementation, beneficiary selection, and inspection. The Decision reiterates that other provisions of Decision No. 33/2013/QD-UBND remain in force except where amended and that any conflicts with higher-level laws must be resolved in favor of the higher-level provisions.
