This is a Decision issued by the Đắk Lắk Province People's Committee on 23 March 2026, promulgating a Regulation governing the purchase and sale of durian in the province. It draws on the Commercial Law, the Law on Food Safety, the Law on Tax Administration, and the Enterprise Law, among others. Its purpose is to regulate the trading, transport, preliminary processing, preservation, and consumption of fresh and processed (frozen, de-segmented) durian, and to define the responsibilities of the traders and state agencies involved.

  • Applies to organizations and individuals purchasing, consuming, or exporting durian in the province, and to other related parties.

  • Defines durian collection points, distinguishing fixed points (permanent, fully equipped for sorting, processing, and packing) from temporary points (short-term, seasonal rented or borrowed sites).

  • Sets operating principles: legal compliance, transparency and fair competition, traceability, food safety, and protection of the Đắk Lắk durian brand; traders must register, declare, and submit to inspection.

  • Obliges traders to comply with quality, food-safety, traceability, growing-area and packing-facility codes, plant quarantine, and origin rules, and prohibits trade fraud and falsifying growing-area or packing codes.

  • Assigns state-management duties across agencies: the Department of Industry and Trade, the Department of Agriculture and Environment, the Department of Culture/Sports/Tourism, the provincial Tax authority, the provincial Police, and commune/ward People's Committees.

  • Covers inspection, examination, and handling of violations under administrative-penalty law, without adding obligations beyond statute.

The Regulation applies province-wide in Đắk Lắk and takes effect on 23 March 2026, the date of the Decision.
