This is a decision of the Bình Thuận Province People's Committee, issued in 2022, that amends and supplements the regulation attached to Decision No. 14/2017/QĐ-UBND on the principles and unit prices for compensating property damage when the State recovers land to build works in the province. It is based on Government Decree No. 47/2014/NĐ-CP, the Law on Construction, and related Ministry of Natural Resources and Environment circulars, at the proposal of the Department of Finance.

• Rewrites Article 2 of the 2017 regulation on compensation principles for houses and structures, including a 1.5x factor for Phú Quý district, a roof allowance, and a 10% recovered-value deduction for organizations/enterprises.

• Sets detailed housing classification standards (grades 2, 3, and 4 with sub-grades) and defines hand-drilled versus machine-drilled wells by diameter and depth.

• Specifies crop and produce compensation: perennial fruit trees as class A at harvest, with 80%, 30%, or 20% for near-harvest, aged, or newly planted; rules for timber/shade trees, acacia and eucalyptus, annual crops, and tobacco by growth stage; State-owned planted forest handled under the Law on Forestry.

• Sets maximum standard planting densities per hectare for many species (e.g., durian and mangosteen 200/ha; dragon fruit 1,110 trellises/ha; papaya 2,500/ha).

• Adds 5,000,000 VND per grave for graves under 36 months old and revises price Appendices 1 and 2 for houses/structures and crops/produce.

• Provides procedures for items not listed in the appendices through district surveys and compensation councils.

The decision applies province-wide in Bình Thuận and takes effect from 1 April 2022; it repeals the earlier Decision No. 10/2021/QĐ-UBND of 7 April 2021 and Article 3 of the regulation attached to Decision No. 14/2017/QĐ-UBND, with transitional rules for previously approved projects.
